1. THE APARTMENT AND TERMS OF THE OFFER
• The written offer: identification of the apartment, floor areas, total price, VAT and included property.
• The apartment plan, its location within the building and identification of the parking space / storage unit.
• Specifications for finishes and fixtures.
• The payment schedule and estimated dates for completion, sale and handover.
• The name and tax identification number (CUI) of the company that will sign the contract with the buyer.
2. THE LAND AND THE RIGHT TO BUILD
• The title deed to the land and an informational Land Registry extract, as recent as possible.
• Documents concerning the developer's right to build and sell, if the developer does not own the land.
• Clarification of the relationship between the landowner, developer and seller, if they are different entities.
3. AUTHORISATION AND PROJECT STAGE
• The building permit, any amendments and extensions.
• The urban planning certificate relating to the authorisation.
• The site plan and approved plans relevant to the building and apartment.
• The urban planning documentation and approval decisions on which the authorisation is based, where applicable.
• Information about the progress of the works and the estimated construction schedule.
• Available documents concerning commencement of the works.
4. LEGAL IDENTIFICATION OF THE APARTMENT AS A SEPARATE UNIT
• The deed of preliminary division into apartment units (preapartamentare) and the related cadastral documentation.
• The Land Registry extract for the apartment as a future property, if an entry has been opened.
• Documents establishing the promised rights over the parking space, storage unit, land and common areas.
If these formalities have not been completed, please indicate their status and what document you propose that we sign in the meantime.
5. CONTRACTS AND ADVANCE PAYMENTS
• Available drafts of the reservation agreement, promise of sale and final contract, with all annexes.
• Terms concerning delays, refunds of advance payments, penalties and changes to the price, floor areas or project.
• Details of the account holder and account to which each payment is requested; for advance payments under the promise of sale, information about the separate account dedicated to the project.
• Documents concerning any guarantees offered for amounts paid.
6. PROJECT FINANCING AND ENCUMBRANCES
• Information about mortgages or other encumbrances over the land and project.
• Available terms and documents from the financing provider for the sale and release of the apartment from encumbrances.
• Information and documents concerning litigation, challenges to permits, enforcement proceedings or other known issues that may affect the project.
7. ACCESS, UTILITIES AND MANAGEMENT
• Documents concerning access to the public road, including rights over private roads.
• The arrangements and timetable for permanent utility connections, with the available documents.
• The terms for management of the development and the costs the buyer would be expected to bear.
